Transcript:
We all know Trump and his swine have had the goal of remaking the entire judiciary in his image over the last decade, the culmination of 5 decades of careful planning by the right in the wake of the civil rights movement to try to “take back their country.” During Trump’s first term, he seemed more focused on placing judges that would move forward a conservative agenda based on the rule of law, this time around he seems deadset on placing judges who will ignore the law and do whatever it takes to “creatively interpret” written laws to bend and mold to the will of the Trump agenda. And it feels as if this entire great experiment to remake the federal judiciary over decades is culminating with the attempted appointment of one man, one dramatically underqualified, evil, sniveling, nosferatu lookin sonovabitch who if he was written into a children’s book as the villain it would simply be too on the nose, too obvious, THIS is the man, Emil Bove, who Trump and his cronies are like yes. YES. Get this man on the BENCH. The Republicans in the Senate Judiciary Committee voted on Thursday to advance Bove’s nomination to the Third Circuit court of appeals, a vote which prompted all Democrats on the committee to walk out, as you saw in the opening clip, because they wanted more debate and to get a whistleblower’s testimony before having a vote. Because Republicans are pushing through Bove’s nomination despite zero judicial experience, despite numerous professional complaints against him by his own colleagues, and despite the glaring can’t miss it neon sign conflict of interest because he was, VERY RECENTLY, like LITERALLY LAST YEAR, Trump’s personal defense attorney in his criminal trial in Manhattan. Today we’re talking about who this creep is and why his appointment will lock in the cruelty of the Trump regime for decades to come.

Emil Bove’s confirmation hearing before the Senate Judiciary committee last month opened with his own opening statement, during which he gave away his ultimate aims right from the start. As a reminder, federal judges are charged with interpreting the law and being the final word on what the law and the constitution says. That is their job. To interpret the law in good faith, no matter what they personally think is right or wrong but instead based on sound legal principles and reasoning. And yet Emil Bove used his opening statement to tout the fact that he does what HE thinks is right, no matter what. [insert clip]
This is, I think, a great representation of the way that the right and Bove’s supporters like to paint him–someone who is tough and not afraid to tell it like it is, to stand on his principles, and he has been persecuted for it unfairly, they claim. Bove is the victim of a mainstream media slander campaign. Ignore the fact that when they are criticizing him, the mainstream media is getting their talking points from some of Bove’s closest colleagues, but we’ll get into that.
First, who is Emil Bove? How does someone become… this? He was born in 1981 and grew up in Seneca Falls, New York. His full name is Emil Joseph Bove THE THIRDDD so you can probably guess what his father’s profession is? That’s right he’s also a lawyer. Emil Bove the THIRD went to SUNY Albany for undergrad, worked as a paralegal for the US attorney’s office in the Southern District of New York before going to Georgetown Law to get his law degree. As an aside it was the students I went to law school with who had worked as paralegals before law school who were the MOST insufferable people to be in class with in law school because they thought they already knew everything. There’s no way Emil Bove the third didn’t fucking suuuuuck to take criminal procedure class with.
After law school he clerked for a federal district court judge, then a second circuit court judge before working as an associate for Sullivan & Cromwell, a law firm in New York City, where he worked largely on criminal defense and regulatory issues, which means he was defending white collar criminals or people or entities under investigation by the government for “allegedly” doing shady shit. After two years as an associate, he moved on to work as an Assistant US Attorney for the Southern District of New York, one of the most prestigious prosecutor jobs a person can get. He worked there for a decade, from 2012 to 2021, mostly on terrorism and narcotics cases, eventually rising to co-chief of the Terrorism and International Narcotics Unit in 2019. In 2022 he left to work at a small law firm in New Jersey for a year, before teaming up with Todd Blanche in 2023 as a partner at Blanche’s tiny firm Blanche Law, a firm that was created to exclusively handle the criminal cases of one man: Donald J Trump. From 2023 to Trump’s inauguration in January 2025, Emil Bove worked exclusively, every day, on defending Trump against his various criminal charges, including serving as his defense attorney during the trial that ended in a guilty verdict on 34 felony counts.
And aligning himself with Trump, as so many lawyers have done before, has paid off for Bove, who, after losing Trump’s criminal trial for him, was swiftly put in place as the principle associate deputy Attorney General under Deputy Attorney General Todd Blanche, who was his partner in the failed defense of Trump’s criminal trial, and under Attorney General Pam Bondi. Reminder that Pam Bondi also acted as Trump’s lawyer, specifically during his first impeachment trial during his first term as president.
Before Todd Blanche was officially approved for Deputy AG, Emil Bove was the acting Deputy Attorney General from January through March of this year. In these roles, Bove has been given vast amounts of power over federal prosecutors across the US, which he happily wielded in Trump’s favor, especially lording over the prosecutors in the Southern District of New York where he originally cut his teeth as a prosecutor. Much of the accusations against Bove’s actions and character stems from his brief few months in power at the AG’s office since January, but complaints against his character and his ethics began long before Trump gave him his quid pro quo appointment earlier this year.
Prior to his work with Donald Trump, prior to his ascension to the highest ranks of the DOJ, Emil Bove was a line prosecutor for the US Attorneys Office in the Southern District of New York. Despite being seen as a hard worker, others who worked with him then also noted he had quite the temper. According to Politico, quote “When Emil Bove… was a federal prosecutor in Manhattan, he developed a reputation as a quiet, diligent worker — but one with a temper.
He belittled the work of his subordinates. He was unusually tough on law-enforcement agents. After one blow-up with a fellow prosecutor, he refused to speak with that person for years and declined to make eye contact even if the two were alone in an elevator.” Politico’s report goes on to say:
“Bove’s troubles first arose around 2018, when he was vying for a promotion from line prosecutor to a supervisory position.
A group of defense attorneys who had worked with Bove, including some who had been prosecutors in the New York office before becoming defense lawyers, believed Bove had deployed questionable tactics, including threatening defendants with increasingly severe charges the lawyers believed he couldn’t prove. When they heard the office was considering elevating him, they communicated their concerns in a letter to the office’s leadership complaining about Bove’s behavior, according to a person involved in the episode.
The highly unusual step resulted in Bove being held back from a promotion.”
But apparently, eventually leadership decided that Bove had made improvements, and so they did promote him to co-chief of the terrorism and narcotics department. During his time in that supervisory role, according to Politico, quote “he quickly garnered a reputation as a manager who was sharply critical of the people who worked for him and unable to control his anger. His conduct was “abusive,” according to one former member of the unit. … “It was the widely held view within the unit — and it filtered up to the U.S. attorney — that morale was really low and people didn’t like working for him,” this person said.” The complaints got so bad that sometime in 2020 or 2021, a formal inquiry into Emil Bove was opened by the executive committee of the US attorney’s office, and after conducting their investigation they recommended that he be removed from his role as a supervisor. Despite this finding, he was not demoted. According to Politico, quote “Part of the reason the office’s leaders did not follow through with their plan to demote Bove was that they were concerned about the optics at the time. While running the terrorism unit, Bove and a co-chief had overseen an economic sanctions case that crumbled after defense lawyers accused prosecutors of failing to turn over exculpatory evidence. The case was eventually dismissed, and a federal judge criticized what she described as a lack of supervision by Bove and his co-chief.” Not long after the incident, Bove left the US attorney’s office to work in that small New Jersey firm for a year before teaming up with Todd Blanche, another former prosecutor in the Southern District of New York, to defend Donald Trump.
And though it has only been 6 months since Trump took office and Emil Bove ascended further up the ladder of the DOJ, like everyone in the Trump regime, Bove has been hard at work moving fast and breaking things.
Last week, over 75 former federal and state judges sent a letter to the Senate Judiciary Committee, calling on them to reject the nomination of Emil Bove. 75 judges were like hey this guy is not only patently unqualified but his lifetime appointment to the federal bench would be deeply concerning on a number of grounds. To give you an idea of the work Bove has been doing since the beginning of this year, let me just read from this letter written by these judges. “We are writing to the Committee to oppose President Trump’s nomination of Emil Bove, his own former personal lawyer, for a lifetime appointment to the U.S. Court of Appeals for the ThirdCircuit.Mr. Bove’s egregious record of mistreating law enforcement officers, abusing power, anddisregarding the law itself disqualifies him for this position. It is disqualifying alone that Mr. Bove targeted or terminated Federal Bureau of Investigation personnel and career Department of Justice (DOJ) prosecutors for honorably investigating violent criminals who assaulted police officers and intended to murder members of Congress and our nation’s Vice President on January 6, 2021. And it is reprehensible that Mr. Bove now refuses to condemn the shameful attack on the dignity and safety of every American that day.It is also disqualifying that Mr. Bove took the lead in scuttling the Department of Justice’s bribery prosecution of New York City Mayor Eric Adams, improperly triggering the resignations of the acting U.S. attorney for the Southern District of New York and a wave of senior lawyers. These are not actions of someone committed to equal justice under the law. Rather, they reflect a troubling pattern of abusing prosecutorial discretion to shield political allies. Such behavior is fundamentally incompatible with the impartiality and independence required of a federal judge.
Now a whistleblower, a DOJ prosecutor who is best known for defending President Trump’s first-term immigration policies in court, alleges that Mr. Bove explicitly plotted to violate court orders and direct law enforcement officers to engage in illegal acts. That whistleblower, Erez Reuveni, has provided members of this committee with compelling evidence and volunteered to testify under oath. The Senate has a duty to hear that testimony. It is also deeply inappropriate for a president to nominate their own criminal defense attorney for a federal judgeship, especially when that president has said he is nominating judges based on whether they will be more loyal to him than to the country. In fact, when President Trump nominated Bove, he posted on social media that Bove would “do anything else that is necessary to, MAKE AMERICA GREAT AGAIN.” That statement underscores the peril of confirming a nominee whose principal qualification appears to be personal loyalty to the president.”
So again, just since January, Emil Bove has fired the prosecutors in charge of cases against the January 6th insurrectionists, and has also targeted the FBI agents conducting investigations into those people. In fact, he helped to lead a new Justice Department effort called the “Weaponization Working Group” tasked with examining prosecutors and FBI employees for their alleged “weaponization” of the DOJ, a favorite MAGA talking point. A memo Bove recently wrote stated that the FBI quote “‘“actively participated in what President Trump appropriately described as ‘a grave national injustice’” by investigating the January 6 US Capitol riot.” Not only that, but when pressed during his nomination hearing Bove only agreed that Biden had been “certified” the winner of the 2020 election, not that he had WON the election.
Bove was also the one who signed the motion to drop corruption charges against Eric Adams, seeking that the charges be dropped without prejudice, so that the case could be re-opened later ostensibly to be able to hold it over Adam’s head and get him to do what he wants. Democrats during the judiciary committee hearing suggested that this dismissal was also a quid pro quo for Bove–get Adams to bend to Trump’s immigration agenda in New York, and Bove will get a coveted judgeship position.
And then there was the whistleblower, a former DOJ prosecutor, who came forward and alleged that Emil Bove told prosecutors in a meeting regarding the case for sending migrants to CECOT in El Salvador, that they should consider saying “fuck you” to judges’ orders. That allegation was revealed in a whistleblower complaint filed days before the judiciary committee hearing. The whistleblower in question was one Erez Reuveni. Reuveni was the prosecutor handling the Kilmar Abrego Garcia case who admitted in open court that Abrego Garcia’s deportation was an administrative error. That admission proved to be a thorn in the side of the administration's ability to fully disappear Abrego Garcia like they did to the hundreds of other men they’ve sent to El Salvador without due process. And in retaliation for that inconvenience, Reuveni was fired shortly after. Now he is saying that Bove told prosecutors to say “fuck you” to judges orders and make sure those flights take off as scheduled, no matter what. The statement also alleges that Trump’s lawyers were not forthcoming with information to Judge Boasberg who was overseeing the case, and that the Department of Homeland Security frequently ignored notices to ground flights. And like, we knew this was happening. We know that the DOJ lawyers in charge of Abrego Garcia’s case dragged their feet, obfuscated the truth, and acted in every way imaginable to delay and avoid Abrego Garcia’s return to the United States, which did eventually happen. So much so that Judge Boasberg found probable cause to hold the Trump administration in criminal contempt for willfully disregarding his orders. We knew this. But to have an official whistleblower complaint filed by an attorney in charge of that work who was in the back rooms with Bove and other administration officials, who has contemporaneous evidence that Bove literally told prosecutors to say “fuck you” to judicial orders is incredibly damning evidence. Of course republican senator and official crypt-keeper Chuck Grassley called the whistleblower complaint a “coordinated political strike” on Bove and Todd Blanche dismissed the whistleblower complaint as something made up by a disgruntled former employee and nothing more than a false hit piece. Despite his supporters so easily dismissing the allegations, Bove himself seemed to struggle to explain his way out of the accusations during the Senate judiciary committee hearing. When Senator Adam Schiff asked him whether he had ordered the planes carrying migrants to El Salvador to take off no matter what, Bove dodged the question saying “I certainly conveyed the importance of the upcoming operation.”
And, according to the Leadership Conference on Civil and Human Rights, a coalition with 250 members that also wrote a letter condemning Bove’s nomination, quote “Bove also established a Sanctuary Cities Enforcement Working Group to target cities with sanctuary protections for immigrants, even calling for legal action to be taken against these cities to challenge their policies. He implemented a new initiative to further this goal called “Operation Take Back America,” which called for a freeze of federal grants to sanctuary jurisdictions and mandated a review of all organizations that receive federal grant money to identify if any “support or provide services to removable or illegal aliens” — and if they do, to cease their funding. These initiatives were given such high priority that despite a government wide hiring freeze, Mr. Bove authorized the hiring of additional assistant U.S. attorneys in all “southern border” U.S. Attorney offices. He warns that resistance to President Trump’s policies “will not be tolerated” and directs the offices to bring cases against what he calls “misguided advocacy groups operating against the public interest” — meaning any organization that provides services to undocumented immigrants.”
AND, according to a separate letter signed by NINE HUNDRED former DOJ attorneys advocating AGAINST the appointment of Bove to the federal appellate bench, Bove’s handling of the Eric Adams dismissal quote “ sent shockwaves through the ranks—cratering morale, triggering mass departures, and eroding the effectiveness of DOJ’s vital work. Prosecutorial authority carries profound consequences on individuals’ lives and the integrity of our public institutions; wielding it without impartiality is a flagrant abuse of that power. Because impartiality is also a cornerstone of the judiciary, any failure to exercise it at DOJ must be carefully considered. … Each of you was elected through a democratic process that, for nearly 250 years, has been anchored by the rule of law. But the law is only as strong as the institutions that interpret and enforce it; foremost among them, the federal judiciary and the Department of Justice. By elevating those who’ve degraded one of those institutions to lifetime seats on the other, you will have abrogated your duty to ensure that we remain a nation of laws.” Again that letter signed by 900 former DOJ attorneys.
Bove and his supporters claim that he has been mischaracterized in a smear campaign by the mainstream media, a common refrain for anyone trying to avoid actually answering for their actions. It’s just a smear campaign by the mainstream media!! Except for the part where it’s just the mainstream media reporting on the allegations, investigations, and reports by his own colleagues and bosses about his questionable conduct and potential ethics and professional violations. He claims he is not Trump’s enforcer or his henchman, that he is acting of his own volition to do what he thinks is right. His actions, I guess, just happen to line up exactly with every Trump executive order and stated policy goal. According to the New York Times quote “Mr. Bove is on good terms with West Wing officials, and he communicates regularly with Stephen Miller, the White House deputy chief of staff, on homeland security issues. But he is not taking their direct orders, so much as acting on Mr. Trump’s general instructions, with the president’s executive orders as his framework, according to people in his orbit.” So I could see how in his twisted little nosferatu shaped head he would construe what he’s doing as his own personal interpretation of what’s right, of his dedication to serving the country and the constitution. It just happens that his interpretation of the constitution also aligns with the Project 2025 unitary executive fringe lunatic theory that the President gets the final say on everything and every part of the government should be subservient to his will. But yeah, no, Emil Bove is just coming up with these things on his own.
And the reason I started this episode off by saying the appointment of Emil Bove to the Third Circuit Court of Appeals for a lifetime judgeship is an example of the culmination of YEARS of effort to push the judiciary into the control of the conservatives, is because this man truly embodies all of the things that Trump and his cronies want to have in a judge, especially on the third circuit which has historically leaned moderately liberal. Not only does he have the obvious deep connection to Trump, a connection which he felt unnecessary to disclose as a possible conflict of interest in his questionnaire for judicial nominees from the senate judiciary committee, because yeah why would it be an issue for a judge to have deep professional ties to the president, spent years defending him in court, probably profited handsomely from that work, and now is getting a nomination to a judgeship no no nothing to see here. Not only is there the obvious ethics issue of having the personal lawyer of the president be a judge, not only does he seem exceedingly willing to go after other prosecutors and FBI agents, not only does he seem to get a real fucking KICK out of those types of power trips, not only does he appear to be an election denier, not only is he fine with requesting the dismissal of a fraud case against the mayor of the largest city in the country in an apparent quid pro quo setup, not only is he capable of the cognitive dissonance that is so quintessential in the Project 2025 MAGA movement where he can do heinous shit and turn around and make tenuous arguments about why it was all perfectly legal and ethical and nothing to see here, what are you even talking about let me gaslight you into thinking YOU’RE the crazy one, a quality Trump LOVES to see in his henchmen, but his history as a prosecutor is also important to note. His own list of his most prominent history as a litigator in his questionnaire for judicial nominees makes it very obvious why his legal background and knowledge would be valuable to have in an appellate court judge. Let’s see if you can notice a theme here.
United States v. Rahimi. “I was part of the team that investigated and prosecuted Ahmad Khan Rahimi, known as the "Chelsea Bomber." On September 17, 2016, based on inspiration from terrorist organizations such as al Qaeda and ISIS, Rahimi detonated bombs in Seaside Park, New Jersey, Elizabeth, New Jersey, and Manhattan, New York.”
United States v. Buryakov, et al.. “I participated in the prosecution of Evgeny Buryakov, who was a member of the SVR, which is Russia's foreign intelligence service. Between 2012 and 2015, Buryakov and two other SVR officers acted as illegal agents of Russia in the United States and engaged in economic espionage operations.”
United States v. Kourani. “I was part of the team that investigated and prosecuted Ali Kourani. The case resulted in the first-ever U.S. trial conviction of a member of Hezbollah's external terrorist operations unit, the Islamic Jihad Organization. Kourani helped Hezbollah and Iran prepare to strike strategic and vulnerable targets around New York City, such as federal facilities housing day care centers, critical infrastructure, counterterrorism command posts, and international airports, as well as members of the NYPD, the Mossad, and the Israel Defense Forces. On May 31, 2017, we charged Kourani with terrorism, immigration, and weapons crimes.”
United States v. Hernandez Alvarado, I was part of the team that investigated and prosecuted Juan Antonio Hernandez Alvarado for a drug-importation conspiracy that involved at least 185,000 kilograms of cocaine, approximately $138.5 million in drug proceeds, multiple murders, and related weapons offenses. Hernandez Alvarado was a Honduran congressman during some of the offense conduct, and his co-conspirators included his brother-former Honduran president Juan Orlando Hernandez Alvarado-and several other Honduran congressmen, military
officials, and national police, among others.
United States v. Campo Flores et al. “I was part of the team that investigated and prosecuted Efrain Campo Flores and Francisco Flores De Freitas in connection with a sting investigation that involved a conspiracy to import 800 kilograms of cocaine into the United States. Campo Flores and Flores De Freitas are nephews of Cilia Flores, who is the wife of Venezuelan de facto leader Nicolas Maduro. Prior to their arrests in Haiti, the defendants indicated that they would source the cocaine from a member of the terrorist organization known as the Fuerzas Armadas Revolucionarias de Colombia, and they agreed to use Maduro's official plane hangar to dispatch the cocaine from Venezuela.”
Emil Bove was a terrorism and narcotics prosecutor. In his role, he became intimately familiar with laws related to terrorism, narcotics, and related criminal offenses. I’m not saying all the cases I just listed are suspicious, I’m saying his successful prosecution of those cases indicates a knowledge and a background that will serve Trump well in his biggest policy initiative: deporting as many immigrants as possible. Because Emil Bove knows exactly how to use the anti-terrorism and anti-narcotics laws, which are favorites when it comes to targeting immigrants for prosecution. Label them terrorists and no one will care WHAT rights of theirs are violated, or whether they completely disappear. So we have a man with deep knowledge of the very laws that have been weaponized against brown people in this country, as well as deep ties to the president, poised to be the newest judge, FOR LIFE, on the Third Circuit Court of appeals. And do you know how judicial nominees for the Supreme Court are often chosen? From among the judges currently sitting on the appellate court bench. Rumors are swirling that Alito and or Thomas may decide to retire at some point while Trump is still in office, opening up new lifetime appointments to the high bench that would align with Trump’s push for younger and younger federal judges to ensure his legacy lasts at the Supreme Court nearly into the next century.
The first federal judge to be confirmed during Trump’s second term was just confirmed last week. 38 year old attorney Whitney Hermandorfer was granted a lifetime position as a judge on the US Court of Appeals for the 6th Circuit. Hermandorfer has six total years of legal experience, roughly half of what the ABA considers to be adequate for someone to be qualified to serve as a federal appellate judge. She worked as a researcher at the conservative think tank American Enterprise Institute where she wrote frequently about corporatizing public education and banning teachers unions, and she directed the Tennessee AG’s Strategic Litigation Unit where she worked to support the state's near-total abortion ban, filed amicus briefs in support of Trump administration actions including the push to end birthright citizenship and his efforts to take control of independent federal agencies. According to reporting from Common Dreams, quote “Rachel Rossi, president of Alliance for Justice, warned Monday that "Hermandorfer's lack of experience, extreme agenda, history of advocacy for the wealthy and powerful, and loyalty to Trump make her an ominous bellwether of what's to come for our courts."” She’s 38. Meaning that even if, God Willing, Trump dies soon from the heart failure people are predicting he’s suffering from, his legacy will live on in his judicial appointees like Whitney Hermandorfer, who could be serving for the next 60 years. Like I said, nearly into the next century. And reminder that Amy Coney Barrett had no judicial experience, was nominated by Trump to the 7th Circuit court of appeals in 2017, and then three years later was nominated to the Supreme Court. She’s 53 now and was older than both Hermandorfer and Bove when she was first nominated to the bench. If Trump’s penchant for young idiots to run things into the ground during his second term is any indication, I would not put it above him to at least consider, sometime between now and 2028, if the opportunity is presented, nominating someone like Bove or even Hermandorfer, who would likely be 40 at the most, to the highest court in the land, cementing a court that is not only conservative but openly hostile towards the rule of law that does not align with the MAGA agenda, for DECADES. With the vote on Thursday by the Senate Judiciary Committee to approve Bove’s nomination, it will now go to a vote on the floor of the Senate, where it is almost sure to be approved, cementing the legacy of one of Trump’s former attorneys in a new and terrible way.
